The commission shall not initiate any action under this Act with regard to any action or decision taken by any officer in any …….. ∝ exercise of his/her discretionary powers. Provided that, if it appears that such discretionary powers have been exercised in a mala fide or arbitrary manner, nothing mentioned in this Section shall prevented the Commission from initiating action in respect thereto.
